General Terms and Conditions of Dahmen & Marhold GbR

§ 1 General – Scope of application

The General Terms and Conditions (GTCs) apply to all services offered by Dahmen und Marhold GbR, including boat trips within Berlin, events on board and catering services. They include boat tours, scheduled tours, event tours and the associated services.

Any terms and conditions of the passenger that conflict with or deviate from these GTCs shall not be recognized unless they have been expressly accepted by us in writing.

The GTCs apply to consumers as well as entrepreneurs and legal entities under public law.

§ 2 Booking and cancellation

Bookings can be made at the ticket offices, directly on the ships and online via the Dahmen und Marhold GbR website or via partner websites.

Online bookings can be made up to 30 minutes before the scheduled departure. There is no right of withdrawal in accordance with § 312g para. 2 sentence 1 no. 9 BGB.

Cancellations are possible up to 24 hours before departure. Cancellations due to force majeure will not be refunded. Otherwise a refund or the issue of a voucher will be offered.

§ 3 Pricing and terms of payment

Payments can be made in cash on board and at the ticket offices, by credit and debit card and online, with no minimum amounts or additional charges.

The prices for the services offered are communicated transparently in advance and include all costs incurred.

§ 4 Liability and insurance

Dahmen und Marhold GbR is liable with the diligence of a prudent businessman for the fulfillment of the services offered, limited to damages caused by gross negligence or intent. No liability is assumed for passengers’ personal belongings.

Liability insurance exists which covers damages within the scope of the statutory liability provisions.

§ 5 Rules of conduct on board

Passengers are obliged to follow safety instructions. Specific rules of conduct, such as the ban on smoking outside designated areas and the ban on carrying dangerous objects, must be observed.

Failure to comply with these rules may result in exclusion from the journey without entitlement to a refund of the ticket price.

§ 6 Events

Age restrictions and conditions of participation apply to events such as dance evenings. Participants must be at least 18 years old, unless otherwise stated. At family-friendly events, children and young people are welcome if accompanied by an adult.

We reserve the right to make changes to the program or to the artists performing and do not entitle you to a refund or price reduction.

§ 7 Catering on board

The consumption of food and drink brought on board is not permitted. Dahmen und Marhold GbR offers a selection of food and drinks for purchase on board. This regulation does not apply to persons who have special needs due to their age or health status that cannot be met by the food and drink on board. Details of the offers and prices are available on board and online.

§ 8 Data protection

Personal data will be treated in accordance with the applicable data protection laws and used exclusively for processing the booked services.

§ 9 Vouchers and vouchers

Vouchers are valid until the end of the third year after purchase. The use of vouchers requires a prior reservation. If a voucher is lost, no replacement can be provided.

§ 10 Safety on board

The safety of passengers has top priority. In the event of an evacuation or an emergency, the instructions of the staff must be strictly followed.

§ 11 Lost property

Lost property will be kept for up to three months. Unclaimed items will be donated to charity or disposed of properly.

§ 12 Prohibited objects

Carrying dangerous substances and weapons is strictly prohibited. Violations will result in immediate exclusion from the ride.

§ 13 Complaints management

In the event of dissatisfaction, passengers are requested to contact our staff or customer service immediately. We will always endeavor to find a satisfactory solution.

§ 14 Applicable law and place of jurisdiction

The law of the Federal Republic of Germany shall apply. To the extent permitted by law, Berlin is agreed as the place of jurisdiction.
